• Personal Guarantees

A Personal Guarantee is a legal commitment where an individual agrees to be personally liable for a company’s debt if the company cannot repay.

• Occupier’s Consent / Waivers

An Occupier’s Consent confirms that someone living in the property but not on the mortgage agrees they have no rights that can override the lender’s and may need to leave if the property is repossessed.

• Third-Party Legal Charges

A Third-Party Legal Charge is when someone uses their own property as security for another person’s or company’s loan.

• Transfer of Equity

A Transfer of Equity involves adding or removing a person from the ownership of a property while the mortgage remains in place.

• Deeds of Subordination

A Deed of Subordination is an agreement where one lender or creditor accepts that their claim will rank behind another’s, giving the other lender priority.

• Joint Borrower – Sole Proprietor arrangements

A JBSP arrangement allows someone to help with the mortgage payments and be jointly liable for the loan while not being a legal owner of the property.

• Gifted Deposit Letters / Deeds

A Gifted Deposit Letter confirms that money provided towards the purchase is a non-repayable gift and gives the donor no rights over the property.

• Corporate Guarantees and Debentures

A Corporate Guarantee or Debenture gives a lender security over a company’s assets or promises repayment if obligations are not met.

Completing and certifying:

• ID1 form

The form is used by the Land Registry to verify of the identity of any individuals during one of the following transactions:

  • Transfer of land or mortgage
  • Transfers of Equity
  • Registering, discharging, or release of a mortgage
  • The purchase or sale of a property or parcel of land
  • The transfer, surrender or grant of a lease
  • Compulsory first registration
  • Mortgage registration
  • Discharge of mortgage
  • Discharge of land
  • Change of name
  • Change of address

• ID2 form

An ID2 form is a document used by HM Land Registry to verify the identity of a corporate body, such as a company, when it is involved in a property transaction and is not legally represented.

• ID5 form

An ID5 is a form used by HM Land Registry to confirm that a person's identity has been verified remotely via a video call.
